1. Definitions
In these Terms, "Heirlune", "we", "us" and "our" refer to the administrative records service operating at 41 Persiaran Gurney, 10250 George Town, Pulau Pinang, Malaysia. "User", "you" and "your" refer to any person accessing the website or engaging our services. "Services" refers to the Terminology and Resource Library subscription, the Personal Papers Sorting and Indexing engagement and the Multi-Generation Archive Programme described on this website. "Agreement" means these Terms together with any scope agreement entered into for a specific programme.
2. Acceptance of Terms
By accessing the website at heirlune.pro or by engaging our services, you confirm that you are at least 18 years of age, have the legal capacity to enter into a binding agreement and accept these Terms in full.
3. Description of Services
Heirlune provides administrative cataloguing, document sorting, indexing, archival rehousing, digitisation and reference information services. All services are administrative in nature. We do not provide legal advice, financial advice, succession planning, tax guidance or any regulated professional service. Nothing in our materials, registers, terminology library or communications constitutes professional advice of any kind.
4. Service-Specific Terms
4.1 Terminology and Resource Library
Access is granted for twelve months from the subscription start date. The Library is provided for general reference only. Content describes publicly available information and does not constitute legal or professional advice. Household access is included; redistribution to persons outside the subscribing household is not permitted.
4.2 Personal Papers Sorting and Indexing
Scope is agreed in writing before work begins. The engagement covers up to 1,000 items unless otherwise stated. Heirlune returns all original documents to the client at handover. Digital scans and register files are delivered to the client and deleted from Heirlune's systems within thirty days of handover.
4.3 Multi-Generation Archive Programme
An eighteen-month programme with scope, timelines and maintenance round dates agreed in writing at the start of the programme. The shared archive is maintained by Heirlune for the duration of the programme. At close, a bound archive file is delivered and the shared archive remains accessible under the terms of the closing agreement.
5. User Responsibilities
- You confirm that you have the authority to share documents with us for the purpose of cataloguing and indexing.
- You accept that our work is descriptive and administrative; it is your responsibility to seek professional advice on any legal, financial or succession matter.
- You will not use the Terminology Library or any Heirlune materials for purposes other than personal household reference.
- You will not reproduce, distribute or commercially exploit any Heirlune materials.
6. Intellectual Property
The content of the Terminology and Resource Library, the website and all materials we produce — including registers, explainers and the family record note — are our intellectual property or used under licence. We grant you a limited, non-exclusive, non-transferable licence to use these materials for your own household reference purposes only.
7. Payment Terms
Programme fees are as stated on the website at the time of engagement: Terminology Library RM 475/year; Personal Papers Sorting RM 1,650; Multi-Generation Archive Programme RM 4,600. Payment terms and methods are confirmed in the scope agreement. For the archive programme, payment plans are available on request. All prices are in Malaysian Ringgit (RM).
Cancellation: For the Library subscription, no refund is provided after access has been granted. For sorting and archive engagements, any work completed prior to cancellation is billable at a prorated rate agreed in the scope agreement.
8. Disclaimers
Services are provided as described in the scope agreement. We make no representation that any document within a collection is complete, authentic or legally valid. The Terminology Library contains general reference information only; we do not warrant its fitness for any specific legal or professional purpose. Nothing in our services constitutes advice on how to proceed with any succession, administrative or legal matter.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Heirlune's liability to you arising from or in connection with these Terms or our services is limited to the fee paid for the programme in respect of which the liability arises. We are not liable for indirect, consequential or incidental losses of any kind. We are not liable for losses arising from your reliance on any Heirlune material as legal or professional advice.
10. Indemnification
You agree to indemnify and hold Heirlune harmless from any claims, losses or costs arising from your breach of these Terms, your misuse of our materials or your provision to us of documents you were not authorised to share.
11. Termination
We may terminate or suspend access to the Library or discontinue an engagement if you breach these Terms and fail to remedy the breach within fourteen days of written notice. You may cancel an engagement at any time in writing; cancellation fees apply as set out in the scope agreement. Provisions relating to intellectual property, limitation of liability and governing law survive termination.
12. Dispute Resolution
We will attempt to resolve any dispute informally in the first instance. If a dispute cannot be resolved within thirty days of written notice, it shall be subject to the non-exclusive jurisdiction of the courts of Malaysia. These Terms are governed by the laws of Malaysia.
13. General
These Terms constitute the entire agreement between you and Heirlune regarding use of the website and services, superseding any prior communications. If any provision is found unenforceable, the remaining provisions continue in full effect. Our failure to enforce any provision is not a waiver of our right to do so in the future.
14. Changes to These Terms
We may update these Terms from time to time. Updates will be published on this page with a revised date. Continued use of our website or services after publication of a change constitutes acceptance of the revised Terms.
